Short Note : Appellants had challenged their convictions under sections 467 and 474 IPC. It was contended that the forged sale deed, having been produced before the Sub-registrar for registration, in view of section 195 Cr.P.C. it was the Sub-registrar who should have lodged the report. Held : So far as the filing of the complaint for the alleged offences by the Sub-Registrar or Registrar is concerned, it is clear from section 195 of the Code of Criminal Procedure itself that the Registrar or Sub-Registrar do not constitute a Court and therefore, the filing of the complaint in the present case by them does not arise. So also there are no facts and circumstances to show that for the offences involved in the instant case, the complaint ought to have been filed in some other Court under section 195 of the Code of Criminal Procedure. Appeal dismissed.
