Short Note : 1. The prosecution evidence itself is of very doubtful nature. The defence version which is supported by the evidence to some extent, appears to be probable and cannot be said to be unreasonable. The character of the prosecutrix Mst. Swaroopi (P. W. 2) herself makes it doubtful if it was a case of section 366, Indian Penal Code. It would not be quite safe to base conviction under section 366, Indian Penal Code, on such evidence. Appeal allowed.
