Short Note : The appellant has filed this appeal against the judgment dated the 27th August, 1974 passed by the Additional Sessions Judge, Alirajpur, in Sessions Trial No. 156/74, whereby the appellant has been convicted under section 302 IPC and sentenced to life imprisonment thereunder for committing the murder of Ansingh in village Kharpat. 2. Admittedly, in the present case, the only eye-witness is Anbai (P.W.3), who is the sister of deceased Ansingh. Apart from her statement, the prosecution has not led any independent evidence to corroborate it. It is not in dispute that the appellant is the son-in-law of Kalsingh who has been murdered prior to this incident. It is also not in dispute, as the prosecution evidence itself has revealed, that it was Balu (P.W.8) who has been sentenced to undergo rigorous imprisonment for causing the murder of his uncle Kalsingh. Thus, admittedly, the relations between the appellant on one hand and Balu on the other, were quite strained and inimical, the dispute being about the agricultural lands. (P.W.3) Anbai, being the wife of Balu, is naturally an interested witness. The FIR lodged by Balu is also on the basis of the information supplied to him by his wife Anbai. Held : Considering the inimical relations between the appellant and Balu, in our opinion, it is not safe to rely on the solitary statement of Anbai (P.W.3) as eye-witness, who is naturally an interested witness, being the sister of deceased Ansingh and wife of Balu. Moreover, her statement is not corroborated by any other independent evidence. The statements of Vesta, Gaju and Balu also appear to be doubtful and biased. It is, therefore, not safe to rely on such type of evidence which is shaky and doubtful, with the result that the appellant is, in our opinion, entitled to the benefit of doubt because of the failure of the prosecution to establish its case beyond reasonable doubt. We are, therefore, unable to maintain the conviction of the appellant as well as the sentence awarded to him by the trial Court. Appeal allowed.
