Short Note : 1. Mr. V.K. Saxena prays for time to produce case diary. Reasonable time having been already allowed, the request is rejected. Held: In spite of the orders of this Court dated 5-6-78 and 9-6-78 for producing police case diary and inspite of the requisitioning of the police case diary by the Government Advocate's Office the police has not cared to make available the case diary to this Court. It appears that the case diary has been withheld. 2. That apart, the applicant appears to be of 16 years of age. Mere accusation of certain offences against the person cannot be treated to be antecedents. The observations made by the learned Additional Sessions Judge that the accused has become a terror of the town appear to be based on no data. Similarly, the apprehension that if released on bail, he will tamper with prosecution evidence is also not well founded unless there has been such an attempt in the past, it cannot be reasonably apprehended that the applicant will tamper with the prosecution evidence in future. Bail granted.
