Short Note : 1. It is an admitted position that Mahila Ramkali is, at present, living with Jagannath her lawful husband. Jagannath procured the custody of Ramkali after obtaining a warrant from the Court. The petitioner merely claims friendship with Ramkali and avers that her husband is not keeping her well and, therefore, he must be given the custody. He states that he was very intimate with Mahila Ramkali, and in the interest of Mahila Ramkali, it would be proper that the custody be given to him. He apprehends that Mahila Ramkali may be sold or may even be roughly dealt with. Held : Having heard the learned counsel, we do not see any right in the petitioner to seek custody of Mahila Ramkali from her husband. This petition does not appear to be bona fide. This Court, apparently, cannot help him in performing something which is not legal and bona fide. We see no substance in this petition and would dismiss it. Petition dismissed.
