Short Note : 1. By this revision, the applicant-defendant seeks interference with the frame of issues made by the trial Court and contended that the proposed issues No.1 to 14, as mentioned in para 4, of the application for revision, should also have been framed. 2. Held : It was contended that there should have been an issue about compensation because in case the suit of the plaintiff was decreed, there would be an occasion at the time of execution of the decree to calculate the amount of compensation. This question is premature and it was not necessary for the trial Court to frame an issue on this count at that stage in the suit for eviction. Similar is the position about issue No. 13. The question of payment of compensation under section 12 (6) of the M. P. Accommodation Control Act, 1961, will arise only at the time of execution of the decree for eviction, if any passed. The point covered by the proposed issue No. 14 is also fully covered by the issue regarding the contentions of the plaintiff that he had received the suit-property on partition, and that he was competent to bring the suit in his own name. Thus, it is found that none of the issues proposed in para 4 of the revision application are necessary. Revision dismissed.
