Short Note : By this petition the petitioner seeks a writ to consider him for promotion and to determine his seniority in the promoted cadre. 2. The petitioner was appointed as Agriculture Assistant, (Lower Division) in Agriculture Department of the State of Madhya Pradesh with effect from 10-7-1962. His name was omitted in a provisional seniority list of the Agriculture Assistants published on 1-4-1969. The mistake was, however, rectified and he was included at serial No. 800. In the meantime, certain promotions were made and since his name was not in the provisional list he could not be considered. 3. Held: It appears that the petitioner had been given adverse remarks in his confidential reports for the years 1967-68 and 1968-69. Afterwards, on the basis of final Seniority List of Agriculture Assistants (Lower Division) in the State, the petitioner's case was considered among other incumbents for promotion. The Departmental Committee, in its meeting held on 26-4-1971 found that the petitioner was not fit for confirmation. There were continuous adverse remarks against the petitioner for the 3 preceding years. These remarks were communicated to the petitioner. 4. It would be seen here that the omission to consider him for promotion earlier did not prejudice the petitioner looking to what transpired later when he was not even found fit for confirmation. 5. Subsequently, on good reports, the petitioner was promoted to the post of Agriculture Assistant (Upper Division) vide, Director of Agriculture, Madhya Pradesh's Order No. A/III/438/73/UD/15662 dated 20-9-1973. The petitioner joined the promoted post on 12-10-1973. The petitioner's grievance is mostly over now. The omission to consider him earlier, as already stated above, did not cause much prejudice to his claim. It is clear from the return that the petitioner's grievance that his case was not considered for promotion and confirmation is wholly without any substance. He is being considered according to rules. Petition dismissed.
