Short Note : 1. It was urged that the prosecution witnesses are partisan witnesses and there is possibility of false implication of the appellants. When number of persons take part in assaulting a victim and when the prosecution witnesses are partisan and inimical approach for appreciation of evidence is mentioned in AIR 1965 SC 202 , Masalti v. State of U. P. The evidence of the eye-witnesses is corroborated by the medical evidence and the FIR and many witnesses were implicating the three appellants. This Court is, therefore, of opinion that there is no room to throw doubt on the participation of the appellants in the attack on Gaurishanker. Appeal dismissed.
