Short Note : By the impugned order the application for leave to defend has been dismissed as time-barred and hence this revision. Held : The application which was filed on 8-11-1977 was barred by time of one day. Order dated 8-11-1977 records that the application in question was filed before the Court on that date. 2. There is power of condonation of delay in the Court as provided in sub-rule (7) of Rule 3 of Order 37 CPC. There must be an application to invoke the jurisdiction to excuse the delay making out a case for the purpose. Admittedly, no such application was made by the defendant-applicant. Therefore, the question of excusing the delay does not arise. Revision dismissed.
