ORDER V.N. Misra, J. - This is a petition u/s 482 Code of Criminal Procedure for quashing proceedings on a complaint filed by opposite party No. 1 against the applicant u/s 420, IPC pending in the Court of the Special Judicial Magistrate, Aligarh (Case No. 90/9 of 1977). 2. The Petitioners have a firm in Allahabad and deal in electrical goods. Very briefly stated they placed an order with the opposite party who also deals in electrical goods at Aligarh. On these goods being delivered to the applicant they gave a cheque which was dishonoured. Sometimes after that the applicant sent a notice to the opposite party saying that the goods were not according to the order and some of them were also damaged and the opposite party filed a complaint against him pending in the Court of Special Judicial Magistrate. The applicant prays that these proceedings on the complaint be quashed. 3. It is very significant that on the goods being delivered to the applicant at Allahabad they did not make any complaint that the goods were not according to the order or that they were damaged for more than three months and for the first time they stated on 23-11-1976 that the goods worth Rs. 563/- were damaged and this complaint was made for the first time after the cheque given by the applicant to the opposite party was dishonoured. It cannot, therefore, be said that there was no criminal intent on the part of the applicants when they gave the cheque without having money in the bank which was dishonoured. The proceedings on the criminal complaint filed by the opposite party cannot, therefore, be quashed. 4. This petition u/s 482 Code of Criminal Procedure has, therefore, no merits and is dismissed.
