Short Note : The impugned judgment is dated 6-7-1972 Copy was applied for on the same day and was ready on 15-7-1972 and delivered on 17-7-1972. However, copy for decree passed by the learned Additional District Judge was not applied for till 13th October, 1972. It was ready on 13-10-1972 and delivered on the same day. The present appeal was filed on 18-10-1972. Thus this appeal is time-barred having been filed beyond the period of limitation prescribed for appeals. I.A. No. 780/73 had been filed under section 5 of the Indian Limitation Act for condonation of the delay. The respondent opposes this application. Held : There is no satisfactory explanation why the copy of the decree was not applied for initially. There is also no satisfactory explanation on the point what the defendant was doing with the copy of the judgment after it was delivered to him. Therefore, it is a case of gross negligence on the part of the appellant omitting to apply for copy of the decree along with the copy of the judgment. No case is made out for condonation of delay involved in filing of the appeal. 1962 JLJ SN 393 and AIR 1962 SC 361 relied on. Appeal dismissed.
