Short Note : 1. The prosecution case at the trial was that Vrihtakar Prathmik Sahkari Samiti, Namli by its resolution of its Board of Directors decided to purchase property of Dulesingh who was a Manager of the aforesaid Society. An agreement was executed between the Society and Dulesingh and it was settled that the Society will purchase the property for Rs. 60,000/- and an advance of Rs. 25,000/- was paid to Dulesingh. On these facts it was alleged that Dulesingh along with the Directors and Chairman of the Society had committed an offence under section 409 IPC. The trial Court acquitted all the respondents holding that it was at the most a civil dispute and no offence under section 409 IPC was made out against the respondents. 2. The President of the Society, it is reported is absconding from the beginning. Dulesingh who was the Manager, is one of the respondents and others are the members of the Board of Directors of the Society. It is also not in dispute that the Society has launched civil proceedings for recovery of amount of Rs. 25,000/- against Dulesingh and also for interest. Admittedly there is no case of criminal breach of trust as the Society entered into an agreement with Dulesingh for purchase of property and after the agreement was executed an advance amount was paid to Dulesingh. Under these circumstances, this Court sees no reason to grant this petition for leave to prefer an appeal against acquittal of respondents. Petition dismissed.
