Short Note : 1. The circumstances fully go to show that the girl was recovered from the house of Chand Tara at Basai which is a part of Agra. She was living there for the last six months. The manner in which she was rescued would corroborate that she was being kept there against her will. The evidence of Bhopalsingh (P.W. 12), Bhaiyalal (P.W. 4), Santkumar (P.W 5) and Virbhan Singh (P.W. 13) fully establishes how Vidha (P.W. 2) was recovered from Agra. The above evidence is cogent and convincing and fully supports the version given by Vidha (P.W. 2). The prosecution in the case fully established that the girl was less than 18 years, that she was induced to live at Agra by accused Chand Tara knowing that it was likely that she would be forced to illicit intercourse with persons who came for prostitution at the house of Chand Tara and for that purpose she was to stay in that house so that Chand Tara may earn at her cost. The prosecution has thus fully established that Chand Tara was guilty of offence punishable under section 366-A of the Penal Code. Appeal dismissed.
