Short Note : 1. By this revision application, the complainant Geetabai challenges the order passed by the Judicial Magistrate, Sonkatch, whereby the cognizance of the complaint was taken only against the non-applicant Ramlal but not against the other non-applicants against whom also a complaint u/s 494/109 IPC was filed Held: A perusal of the statements made by the complainant Geetabai (PW. 1), Mangilal (PW. 2) and Prahlad (PW. 3) shows that according to their statements, the remaining accused were also present when despite the objection raised by the complainant Geetabai, the marriage was celebrated. This is not the stage at which the question of reliability or otherwise of the evidence given by these witnesses should be examined. All that can be examined is whether there were grounds for proceedings against the other accused also. This question was not rightly decided by the learned Magistrate as in may opinion there were grounds to proceed against the remaining accused also. Revision allowed.
