Short Note : Held : The evidence of the inmates of the house who were injured in the incident in fact suffers from certain infirmities. The evidence of Vitthal (P.W.11) Bhuwarsingh (P.W. 14) and Mansingh (P.W. 13) also does not appear to be quite satisfactory. The other two are also interested witnesses. Their evidence also in any case requires corroboration. At least two of the witnesses who were injured in the incident could not identify anyone of the miscreants due to darkness. The prosecution did not examine some of the material witnesses and for that reason an adverse inference has been drawn against the prosecution. Appeal dismissed.
