Short Note : 1. The learned Sessions Judge Guna convicted the petitioners under section 324/34 IPC and sentenced them to undergo simple imprisonment till rising of the Court and a fine of Rs. 100. Held: One of the points the learned counsel mentioned before the Court was that the first information report was lodged late. This argument was put forward before the appellate Court also, The appellate Court has given cogent reasoning for holding that the alleged delay is not fatal to the story of the prosecution. The police station is about 14 miles away from the place of incident and. therefore, if there is some delay, it cannot be held that there was false implication and the story given by the prosecution should he disbelieved. The incident took place at about 4 P.M. on 19-9-1971 and the first information was lodged at about 9-30 A.M. on 20-9-1971. Revision dismissed.
