Short Note : 1. The applicant had been convicted under section 323 of the Indian Penal Code, and sentenced to suffer rigorous imprisonment for one year. Held : In fact the applicant should have been dealt with under section 4 of the Probation of Offenders Act since at the time he committed the offence, he was a boy below 18 years This Court is inclined to give him benefit of section 4 of the Probation of Offenders Act.
