Short Note : 1. Mst. Rama filed a complaint under section 107/117 of the Code of Criminal Procedure against Sukhu and others on 6-2-1973 which was the date fixed for evidence, the Sub-Divisional Magistrate dropped the proceedings as having become time barred. Against that the revision was filed before the First Additional Sessions Judge. The only point decided by the learned Additional Sessions Judge is that from what date the time should be calculated. The time is to be calculated from the date of the order under section 118 Cr. P.C. and not from the date of the notice. Therefore the order passed by the learned Sub-Divisional Magistrate on 6-2-1973 cannot be sustained and the result will be that the reference will have to be accepted and the order passed on 6-2-1973 by the Sub-Divisional Magistrate will have to be set aside.
