Short Note : It is, no doubt, true that P.W.1 Rammilan and P.W.3 Holaram both have correctly identified the appellants as persons who along with others had committed the dacoity. But this is merely their ipse dixit, since no particular distinguishing feature of any of the dacoits was mentioned either in the first information report or even later while giving statement in Court in order to disclose the basis for identifying the appellants. The time-lag between the arrest of the appellants and the holding of the test identification parade was more than a month and no explanation for this inordinate delay has been given on behalf of the prosecution. In the opinion of this Court, this factor makes it unsafe to rely on the only evidence accepted by the trial Court for convicting the appellants. Appeal allowed.
