Short Note : 1. Since the appellant assaulted the deceased with a Danda and the injuries caused were fractures of 3rd and 4th ribs the appellant will be held guilty for voluntarily causing grievous hurt to Kowa. In the circumstances, he could be properly convicted under section 325 of the Indian penal Code and not under section 302 I.P.C. Appeal allowed.
