Short Note : 1. This is a defendant's revision application and arises out of an order passed on an application made under Order 9 rule 13 of the Code of Civil Procedure for setting aside of an ex parte decree passed against the applicant in favour of the non-applicant on 12-4-1972. Held : No doubt the applicant was granted 15 days time to deposit the amount of Rs 75 awarded as costs to the plaintiff as a condition precedent for setting aside ex parte decree. The trial Court had jurisdiction under fection 148 Civil Procedure Code to extend the time either before its expiry or even after the time had expired. The applicant had made an application for reducing the amount of costs and also for staying the operation of the order. The stay was granted within 15 days from the date of the order passed on 13-2-1974. In these circumstances the trial Court should have extended the period for payment of Rs. 75 and allowed the applicant to deposit the same within the extended period. It appears that the provisions of section 148 Civil Procedure Code were not at all considered. However as the matter has now come before this Court the time fixed by the trial Court on 13-2-1974 is extended to the date of actual deposit made by the applicant on 2-4-1974. As the deposit has been made the ex parte decree shall be treated 8S having been set aside. 2. The trial Court should now proceed with the trial of the Suit according to law. Revision allowed.
