Short Note : 1. The petitioner was Principal of a Higher Secondary School. The school was run by Janapada Panchayat. The school along with other similar schools was taken over by the State Government from 19th August 1974. The Government by order dated 21st December 1967, laid down the Principals for absorption of the staff of these schools in Government service. The petitioner was absorbed as Lecturer in Government Service. Held : The petitioner has not been absorbed as Principal by' the State Government on the ground that he did not work on the post of Principal for, a continuous period of seven years. The contention of the State is that the petitioner worked as Incharge Principal for the period from 11th November 1965 to 1st March 1969, and this period should not be counted for finding out whether the petitioner worked on the post of Principal for seven years. Assuming that the petitioner worked only as Incharge Principal during this period, the State is not correct in its submission that this period should not be taken into consideration for finding out whether the petitioner worked as Principal for a continuous period of seven years. Satyendra Prasanna Yadav v. State of M.P. and others, M.P. No. 368 of 1973 decided on 14 April 1976. Petition allowed.
