Short Note : 1. In this appeal, the appellant Wajid Ali has challenged his conviction under section 324 of the Indian Penal Code for which he was sentenced to undergo rigorous imprisonment for one year. 2. The prosecution case is this: On 23-9-1977 at about 11.30 p. m., Ahmed Khan (PW1) with his friend Hajoo alias Samad Khan (PW6) was going to his house in Naya Mohalla, but on the road near the house of Ahmed Khan (PW1), the appellant after some talks caught hold of him and inflicted a Gupti blow on the left lateral side of the chest. Ahmed Khan (PW1) lodged the first information report (Ex.P.1) at 11.40 p. m., the same night. Held: Shri Surendrasingh prayed for reduction in the jail sentence on the ground that the appellant is the first offender and that the relations between the victim and the appellant were not cordial in the past. There was verbal altercation preceding the attack. The appellant is aged about 25 years. The record disclosed that the appellant has already suffered 34 days of imprisonment. Looking to the facts and the circumstances of the case, this will be sufficient punishment for the offence under section 324 of the Indian Penal Code Beside this fine of Rs.250 or, in default, to suffer two months rigorous imprisonment will meet the ends of justice. Appeal partly allowed.
