Short Note : It will be apparent from the record that the appellant was charged with the murder of his father-in-law at the police station by the village people. The persons to whom Mst. Jankibai (P.W.5) made the statement immediately after the occurrence, the extra-judicial confession made the appellant, the seizure of the human blood stained axe and the Pajama from the appellant together with his suspicious conduct indicated that the appellant was responsible for the death of his father-in-law. Besides this, the extra-judicial confession is proved by the independent witnesses and was voluntary and is also corroborated by the prosecution evidence including the siezure of the blood stained axe and the Pajama from the appellant. The totality of the circumstances as enumerated above leave no room to doubt that the appellant was definitely the assailant of his father-in-law. Maghar Singh v. State of Punjab, AIR 1975 SC 1320 relied on. Appeal dismissed.
