Short Note : 1. The petitioner filed the present petition for dissolution of marriage by a decree of divorce on the ground that the respondent who was his wife had illicit sex relations with several persons and was living in adultery and that his marriage with the respondent was not consummated. The trial Court held that the appellant had failed to prove that his marriage with the respondent was not consummated and that the respondent had illicit sex relations with any person. Held: On appreciation of the evidence led by the parties, this Court is of the opinion that the appellant had made vague and reckless allegations against the respondent and the evidence led by him was also vague which was rightly been disbelieved by the trial Court. The trial court also held the appellant as unreliable witness. Considering the conduct of the appellant and of the members of his family, this Court is of the opinion that the lower Court was justified in holding that there was no substance in the allegations made by the appellant against the respondent. The lower Court had the opportunity to see the demeanour of the witnesses examined by the parties and no ground has been made out how the appreciation of the evidence by the Court below is not reasonable and requires inference by this Court in appeal. Appeal dismissed.
