Short Note : 1. The application for ad-interim maintenance happened to be rejected because by the time hearing on the same could be completed, the case itself was ripe for making the final order. Under these circumstances, the Additional District Judge was of the view that since the provisions of section 24 of the Hindu Marriage Act provide for awarding maintenance and expenses of litigation during the pendency of the proceedings till final disposal and since the petition itself was being disposed of that very day, there was no need for making any order under section 24 of the Act. Held : The preliminary objection raised by the respondent about the tenability of this appeal is therefore allowed and this appeal is dismissed as not tenable. Radhey Shyam Gupta v.
