JUDGMENT H.N. Agarwal, Member - This is a reference, made by the Additional Commissioner, Lucknow Division, recommending that the revision filed by Smt. Ram Dulari, against the order dated September 9, 1970, passed by S.D.O. Mohanlalganj, in a case under section 229-B/209 U.P.Z.A. and L.R. Act, may be allowed, the impugned order set aside and the case remanded to the trial court with the direction that he will allow the amendment and decide the case thereafter. 2. I have heard the learned counsel for the revisionist and have gone through the record. The opposite party has not appeared in the case despite due service. 3. Smt. Ram Dulari had filed a suit under section 229-B/209, U.P.Z.A. and L.R. Act against Mahadeo Singh and others. The defendants filed a written statement. On September 9, 1970 she moved an application for the amendment of the plaint wherein a request was made that in the original plaint the plot numbers were given as they were before Chakbandi and now she may be allowed to substitute them by new numbers after the Chakbandi. This simple application for amendment has been rejected by the trial court by the impugned order. 4. The learned Additional Commissioner has rightly referred to the Supreme Court's ruling given in 1957 RD 363 which is to the effect that all amendments should be allowed which satisfy two conditions :- (i) not causing injustice to the other side, and- (ii) of being necessary for the purpose of determining the real question in controversy between the parties. 5. The learned Additional Commissioner has correctly held that in the light of the above principle, the amendment should have been allowed and that in refusing the amendment, the trial court has failed to exercise jurisdiction and has acted illegally and with material irregularity in the exercise of jurisdiction. 6. Agreeing with the recommendation, made by the learned Additional Commissioner, allow the revision, set aside the impugned order and remand the case to the trial court with the direction that he will allow the amendment and thereafter decide the case according to law.
