ORDER It appears from the record that the appellant should have been promoted with effect from 1st January. 1977 since the penalty of reduction to the minimum of the time scale worked itself out on 23rd December, 1976 and thereafter there was no impediment against the promotion of the appellant. 2. We accordingly direct that the appellant be promoted with effect from 1st January, 1977 and arrears of wages together with admissible allowances on that basis may be paid to him within a period of two months from today, after taking into account all such payments as may have been made to him for the period from 1st January, 1977. 3. We hope and trust that the appellant will carry out his duties on the promoted post loyally and faithfully and offer his utmost co-operation and respect to his superiors and his superiors will also treat him properly without bearing any resentment for the past events. 4 There will be no order as to costs of the appeal. While disposing of the appeal on September 14, 1979 we had said that there will be no order as to costs in the appeal. We modify that order in regard to costs and direct that the appellant will be entitled to costs from the Respondents which we fix at Rs. 500. We further direct that the court fees payable by the appellant shall be recovered from the respondents from out of the costs payable by them to the appellant.
