Short Note : 1. This is an application made by the State under section 5 of the Limitation Act for condonation of delay in filing the appeal Held : On perusal of the certified copy of the judgment it is clear that it was delivered on 26-12-77. Thus, after obtaining the copy of the judgment the appellant ought to have known that the appeal was to be filed latest by 24 March 1978 and yet the papers pertaining to the case were sent to the Director Mandi M. P. Bhopal for report on 15th March 1978. Thereafter, the papers moved from one department to another or from one section to another in routine manner without any anxiety on the part of any of the officer or officials concerned that the period of limitation was to expire on 24th March 1978. That shows the latches on the part of the appellant. This Court is therefore of the view that the appellant has failed to explain the delay in filing the appeal beyond the period of limitation and hence this application must be rejected.
