JUDGMENT I.B Singh and Mr. P.C. Saxena, Members - A question has been referred to this Bench for a ruling as to whether during the pendency of consolidation proceedings, proceedings under Section 122-B of the U.P. Zamindari Abolition and Land Reforms Act could proceed against a trespasser over Gram Sabha Land or whether they should abate under Section 5 (2) of the Consolidation of Holding Act. 2. A perusal of Section 5 (2) of the Consolidation of Holding Act would show that the legislature has contemplated abatement of only those proceedings in regard to which proceedings could or ought to be taken under the Consolidation of Holdings Act. 3. Proceedings for ejectment under Section 122-B of the U.P. Zamindari Abolition and Land Reforms Act cannot be taken under the Consolidation of Holdings Act as there is no analogous section is this Act under which the same would be maintainable. It therefore follows that there should be no abatement of such proceedings under Section 5 (2) of the U.P. Consolidation of Holdings Act. 4. The reference is answered accordingly.
