Mehrotra, J. - When this application, accompanied by a certified copy issued to the applicant of the judgment of this court dated June 30, 1980, was presented it was discovered that the judgment of the court related to a case other than the one in which it purported to have been passed according to the certified copy of the judgment. 2. Further enquiry revealed that on June 30, 1980 two Second Appeals, namely, Second Appeals No. 1457 of 1970 (Chandika v. Sukhnandan, District Jaunpur) and Second Appeals No. 2834 of 1971 (Natthi Lal v. Smt. Kapuri Devi, District Agra) were heard and decided and judgment in both of them was dictated in open court. The two judgments had been taken down in shorthand by the same judgment-writer. By inadvertence, however, the judgment dictated in Second Appeal No. 1457 of 1970 was taken down under the heading of Second Appeal No. 2834 of 1971 and transcribed under that heading by him. Likewise, the judgment in Second Appeal No. 2834 of 1971 was taken down under the heading and particulars of Second Appeal No. 1457 of 1970 and transcribed thereunder by him. 3. It is obvious that the particulars of the two appeals got inter-changed on account of an accidental slip on the part of the judgment-writer and the error in that regard crept in the judgment inadvertently. Such an error, it is settled, can be corrected by the court in exercise of powers under Section 152, C.P.C, (See Samrendra Nath Sinha v. Krishna Kumar Nag, AIR 1967 SC 1440 ). 4. Let the error in the heading of the two judgments regarding the numbers of the Second Appeals and the particulars of the parties be corrected forthwith. After that correction, the certified copy of the judgment be issued to the applicant, as prayed, on the same folio. A copy of this order may also be placed on the record of Second Appeal No. 1457 of 1970 (Chandika v. Sukhnandan).
