ORDER : We are of the view that the question at issue between the parties does not appear to have been properly considered by the Appellate Authority as also by the High Court and the judgment of the Appellate Authority seems to proceed upon a wrong assumption that the partnership deed must expressly provide that the business must be carried on by all or by every one acting on behalf of all and the judgment of the High Court also suffers from the fallacy that it is a necessary condition of a valid partnership that the partnership deed should provide that each of the partners is entitled to run the business of the partnership. We, therefore, allow the appeal, set aside the judgment of the High Court as also the judgment of the Appellate Authority and remand the case to the Appellate Authority so that it may dispose of the appeal before it in accordance with law in the light of the observations contained in this judgment. The parties will appear before the Appellate Authority on 29th September, 1980 so that the Appellate Authority can give suitable directions for taking up the appeal for hearing and it will dispose of the appeal as early as possible and in any event not later than 31st October, 1980. There will be no order as to costs. Appeal allowed.
