JUDGMENT S. Malik, J. - This is an application in revision by Ram Prasad against his conviction under Section 16 read with Section 7 of the Prevention of Food Adulteration Act and the sentence of six months rigorous imprisonment and a fine of Rs. 1,000/. 2. The relevant facts are that on, April 23, 1977 at about 11 a.m. in the morning sample of milk was purchased by the Food Inspector from the applicant according to law. The portion sent to the Public Analyst was reported to be adulterated as it was deficient in nonfatty milk solids by 15 percent. The percentage of milk fat was adequate. 3. It was argued that there is no known method by which nonfatty milk solids could be taken out of milk without disturbing the contents of milk fat and the nature of the milk. In a case of this nature the Public Analyst should have explained how this could have been done or if he found any extraneous substance like water etc. in the milk. Under the circumstances, the report of the Public Analyst could not be said to be reliable. It is, therefore, held that the prosecution failed to prove that the milk was adulterated. 4. The application is allowed and the order passed by the lower court convicting and sentencing the applicant is set aside. He is on bail. He need not surrender and his bail bonds are, hereby, discharged. If he has deposited any amount as fine, the same shall be refunded.
