JUDGMENT P.N. Bakshi, J. - The applicant has been convicted under section 7/16 of the Prevention of Food Adulteration Act and sentenced to six months R.I. and a fine of Rs. 1000/- is conviction and sentence have been maintained in appeal by the sessions Judge, Agra. Hence this revision. 2. The list has been revised. I have perused the impugned order. The sole point which has been pressed in the grounds of revision is with regard to non-compliance of Rule 9(j) of the Rules framed under the Prevention of Food Adulteration Act. 3. In the instant case a sample of cows milk was purchased by the Food Inspector on 24-2-1975 in accordance with the procedure prescribed by law. One of the sample phials which was sent from the office of the Chief Medical Officer was analysed by the Public Analyst, who reported that it was deficient in fat contents by 26 per cent and in non-fatty contents by 22 per cent. On these allegations the applicant was prosecuted and convicted as above. 4. The court below' has considered the question of observance of Rule 9(j) of the P.F. Rules. In the first place those Rules were not mandatory but were only directory. In the second place. I find that Raghubir Singh, Food Clerk has appeared in the witness box with his register to prove the despatch of the report of the Public Analyst to the accused. The A.D. Receipt has also been filed which was addressed to the accused. This acknowledgement bears the signature of the accused, as admitted by him. The Food Inspector has also corroborated all this documentary evidence by his statement that the report of the Public Analyst was sent to the accused. Thus I do not find any error in the findings recorded by the courts below that the Report of the Public Analyst was sent to the accused and there has been full compliance of Rule 9(j). 5. Since the adulteration in the instant case was both in fatty and non fatty solids to the extent of 26 and 22 per cent, I am not inclined to give any relief even on the question of sentence. 6. There is no merit in this revision which is hereby dismissed. The applicant is on bail. He shall be taken into custody forthwith to serve out the unexpired portion of the sentence of imprisonment.
