ORDER : A.C. Gupta, J. - Special leave granted. 2. The appellant, Ram Chander was convicted under Sections 366 and 354 of the Indian Penal Code and sentenced to rigorous imprisonment for two years under Section 366 and six months under Section 354. He was also sentenced to pay a fine of Rs. 200. Ram Chander was tried along with another accused, Billa. The Sessions Judge found that the evidence against both the accused was co-extensive and identical but he felt a "lingering doubt" about the complicity of Ballia and acquitted him. 3. Having considered the facts and circumstances of the case we do not find any difference between the cases of Billa and the present accused and accordingly we allow the appeal and acquit this accused also. Appeal allowed.
