JUDGMENT Murlidhar, J. - Revisionist Desh Raj has been convicted under section 7/16 Prevention of Food Adulteration Act and sentenced to R.I. for six months and a fine of Rs. 1000/- in default simple imprisonment for three months. 2. The prosecution case was that on 25-11-75 at about 4-00 p.m. the Food Inspector had taken a sample of Maida from the revisionists Parchun Shop in Ajit Nagar Kheria within the limit of Nagar Mahapalika. On analysis by the Public Analyst this Maida was found adulterated because firstly there were found dead larvae and insects in the sample and accordingly the glutin contents was 5.2% only as against the prescribed limit of 7% and the alcoholic acidity was 0.25% as against the prescribed maximum of 0.18%. The revisionist in his statement had stated that he only brought some Maida on retail from the Bazar and. sold it immediately in his shop. He also examined a witness in defence that this Maida was purchased by Shoe-makers and attached-case makers for making paste. The defence was disbelieved by the courts below. 3. The learned counsel has not pressed the appeal on merits but prayed for reduction of sentence pointing out that this is a case of the year 1975 when the present stringent provision of minimum sentence introduced by the Act 34 of 1976 were not in force. There is only one factor which permits me to remit the remaining jail sentence (the revisionist has already served a few days after the appellate court jundgment and before being bailed out in pursuance of this Courts order dated 16-5-80). The occurrence relates to November, 1975 and the revisionists trial lasted well nigh four years from 5-7-76 to 15-5-79 involving about 27 hearings. He has, therefore, already been harassed quite a lot. 4. The revision is partly allowed. The conviction of the revisionist is confirmed but the sentence is reduced to the period already undergone plus a fine of Rs. 1000/- in default further R.I. for three months. The revisionist is on bail in pursuance of this Courts order dated 16-5-80 and need not surrender. Two months time from the date of record in the courts below is allowed for payment of fine. The applicant shall be got arrested in case the fine is not paid within the time allowed.
