JUDGMENT B.K. Misra, Member - The revisionist Smt. Sukhrani filed this revision against the order of the learned Deputy Commissioner, Hardoi, in a mutation proceeding. The Naib Tahsildar had decided the mutation against Smt. Sukhrani and the learned Deputy Commissioner had upheld that order. 2. In the instant revision a point has been raised that Sri K.P. Singh, Naib Tahsildar who decided the mutation case was an officiating Tahsildar with only 6 months experience, hence the order of the learned Naib Tahsildar was without jurisdiction. A reference was made to Gezette Notification No. 1150/(B)-RS/IA-1300-58, dated August 31, 1959 published in the U.P. Gazette No. 1, dated September 5, 1959: By this notification the Governor conferred the powers exercisable under Section 224 of the Land Revenue Act upon all permanent Naib Tahsildar's and all Officiating Naib Tahsildar's who have officiated as such for a period aggregating to not less than one year. In view of this notification Sri K.P. Singh who had at the time of deciding the mutation proceeding less than one year's officiation passed the order without jurisdiction. 3. The revision is allowed and all the proceedings till now are quashed and the case remanded to the Tahsildar, Sandila, district Hardoi for getting the mutation proceedings disposed of afresh.
