JUDGMENT 1. - Accused Narayan, Achchey, Fattey, Bhim, Chunni and Bharati were tried by the learned Sessions Judge, Bharatpur under Sections 147, 148, 323, 325, 452 and 307, IPC in connection with the occurrence which took place on 27-9-1974 at 5 p.m in Kama down. The learned Sessions Judge after taking into consideration the evidence produced on behalf of the parties and the arguments advanced before him, acquitted all the accused of the charges punishable under sections 307 and 147, IPC. Accused Deviram and Hari were acquitted of the charges framed against them. However, accused Narain, Achchi, Fattey, Bhim, Chunni, Hardayal and Bharti were convicted of the offences charged and sentenced to each term of imprisonment under each section vide judgment dated September 29, 1975. 2. The convicted accused have challenged the verdict of the trial court by this appeal. The learned counsel appearing on behalf of the appellants has placed on.record a compromise dated 15/7/1977, duly verified on 29/9/1977 as the parties belong to the same village.and are close relations and have settled the dispute out of Court. I am of the opinion that it would be in the interests of justice to allow them to compound the offence under Section 325, IPC. The rest of the offences are compounded between the parties. 3. I, therefore, accept the compromise. In view of the compromise produced on record, the conviction of the accused is set aside. All the accused appellants shall stand acquitted of all the charges framed against them. The appeal is allowed as indicated above. They are on bail. They need not surrender to their bail bonds.Compromise accepted. *******
