JUDGMENT : 1. Heard counsel. Special Leave granted. 2. By an order dated July 27, 1981, this court had directed that notice be issued to the respondents to show cause as to why the order passed by the High Court of Calcutta on July 20, 1979 in Second Appeals Nos. 1316-18 of 1971 should not be set aside. The Respondents have been served, but do not appear. Taking into account the relevant circumstances bearing on the question which is in issue before us, we are of the opinion that this is a proper case in which the aforesaid appeals which were filed by the appellant in the High Court of Calcutta should be restored. We order accordingly and direct that the aforesaid appeals shall be heard and disposed of by the High Court on merits. There will be stay of dispossession until the disposal of the appeals. The application for substitution is allowed. 3. The appeal will stand disposed of in terms of this order. There will be no order as to costs.
