JUDGMENT S.Z. Hasan, J. - Anil Sharma is involved in a murder case. He claimed identification and on October 16,1982 the learned Magistrate observed that the prosecution was unwilling to put the accused on test identification and therefore, the application be kept on the file. The complainant has engaged a counsel who states that some time may be given to him to file counter-affidavit. This is nothing but a delaying tactics and the request is refused. The accused was claiming identification and the prosecution was not willing to hold identification test. The applicant be released on bail on his furnishing adequate sureties and bond to the satisfaction of the C.J.M. concerned.
