JUDGMENT Y.V. Chandrachud, CJI. - We uphold the reservation of seats for candidates from backward areas identified on the basis of the reports of the Wazir Committee and the Anand Committee, and on the basis of Census Reports. 2. The Selection of candidates for admission to the additional 35 seats from areas claimed to have been discovered to be insufficiently represented is struck down. These 35 seats shall be distributed as if the original number of seats had been increased by 35, subject to the approval of the Indian Medical Council in regard to the increase in the over-all number of seats. 3. The reservation of seats for children of members of the staff of the Medical Colleges is truck down. 4. We are of the opinion that though interview of candidates as one of the tests of admission to educational institutions cannot be considered as bad or unreasonable in the abstract, the manner and method in which interviews were held in the instant case were arbitrary and must, therefore, be struck down. The interviewing body set before itself an, impossible task which led to haphazard assessment of candidates and arbitrary allotment of marks to them. Having regard to the time factor and the events which have intervened, we direct that the selection of candidates shall be finalised after excluding the marks obtained by the various candidates at the interview. No fresh interviews shall be held for admission to the seats involved in these proceedings. 5. The Petitioners will get their costs from the Respondent which we quantify at Rs. 5,000/-. 6. The reasons for these conclusions will follow later.
