JUDGMENT R.M. Sahai, J.- The revision filed by the petitioner was dismissed as incompetent for not complying with rule 111 of the U.P. Consolidation of Holdings Rules. It has been held by this Court that if the records are summoned by the Deputy Director of Consolidation then he is not empowered to dismiss the revision for failure on the part of revisionist, to file certified copies of the order passed by the Consolidation Officer. From the order of the Deputy Director of Consolidation it is apparent that the order was passed after summoning the record. As the records were before the revising authority he could not dismiss the revision for non filing of certified copies of the order passed by the Consolidation Officer. 2. During pendency of this petition opposite party transferred land in dispute to Mewa Lal who had been is leaded as party in this petition. It is not necessary to decide at this state whether transfer could have been made or not as the Deputy Director is being directed to decide the dispute on merits. It shall be open to him to consider this question as well. 3. In the result this petition succeeds and is allowed. The order passed by the Deputy Director of Consolidation is quashed. He is directed to decide the claims of the parties afresh on merits in accordance with law. Parties shall bear their own costs.
