JUDGMENT : 1. Heard counsel. Special leave granted. 2. In view of the affidavit filed by shri T.V. Balakrishnan in this Court, we modify the impugned order by directing that the appellant herein, who was the first respondent in the High Court, shall furnish Bank guarantee or security in the sum of rupees fifty thousand (instead 5 of rupees seventy five thousand) to the satisfaction of the Registrar of the High Court within three months from today. The appellant herein shall give the Bank guarantee or security as stated above even if the High Court appeal is disposed of, provided of course he fails in that appeal. 3. The appeal will stand disposed of in terms of this order. There will be no order as to costs.
