JUDGMENT 1. - This is an appeal against acquittal of Vijay Singh, who is challaned for offence under S. 354 I. P. C. 2. I have heard the learned Public Prosecutor for the State. No-one has appeared for the accused. 3. On a careful consideration of the statement of P.W. 4 Gopi, P.W. 5 Hajari, P.W. 6 Balu, P.W. 3 Laxmi, P.W. 2 Radha and P.W. 1 Mst. Gulabi, the trial Magistrate has come to the conclusion that no act of outraging the modesty has been alleged muchless proved. I have gone through the statements of these witnesses and I find that though the conduct of the accused was reprehensible as he abused and tried to chase the girls and ladies but so far as offence of outraging the modesty under S. 354 is concerned, the allegations even if alleged to be proved, are not sufficient to fulfil the necessary ingredients. 4. I would have remanded the case for fresh trial for offence under S. 509 I.P.C. but I find that the offence was committed in the year 1972 and it would not be proper to remand the case after one decade. 5. Under the above circumstances, the acquittal of the accused is up held and the appeal is dismissed.Appeal dismissed. *******
