JUDGMENT : Since by an order dated 24th July 1981 this Court directed that the Petitioners will surrender before the Chief Judicial Magistrate, Meerut and on such surrender, the learned Chief Judicial Magistrate will release them on bail on furnishing surety in the sum of Rs. 10,000/- with personal bond for the same amount and pursuant to the said order, the Petitioner have been released on bail, it is no longer necessary to decide whether Section 9 of the Criminal Procedure Code (U.P. Amendment) Act 1976 which has deleted Section 438 of the Criminal Procedure Code in the State of Uttar Pradesh is constitutionally valid or not. The Writ Petition is accordingly infructuous and will stand disposed of in these terms.
