State of Kerala v. Kalaprakkal John Andrew

1982-01-28

D.A.DESAI, P.N.BHAGWATI

body1982
JUDGMENT : 1. Special leave to appeal granted in all the matters. 2. These appeals by special leave are directed against a judgment of the Kerala High Court which laid down certain formulae for regulating admissions to Medical College in the State of Kerala for the academic year 1981-82 as also for the subsequent academic years. The Kerala High Court has in regard to the academic year 1981-82 suggested a certain formula but we think that a different formula will meet the ends of justice and after arguments were advanced before us for sometime, all the parties agreed that the formula suggested by us would be fair and just and would ensure proper admissions to the Medical Colleges for the academic year 1981-82. The formula suggested by us is that there shall be an entrance examination for all eligible pre-degree and other students who have already applied for admission to the Medical Colleges. The entrance examination shall be held by the State Govt. on 2 days, namely, 27th and 28th February, 1982 in four subjects, namely Physics, Chemistry, Botany and Zoology, and out of the Examiners, at least 500%, shall be from outside the State. The paper in each of these four subjects will carry 50 marks and will be of two hours' duration. The result of the entrance examination on the basis of centralised evaluation will be declared on or before 2nd March, 1982 and admissions will be granted on the basis of such result, subject of course to the reservations already made including ?rd reservations for students of the Calicat University and other mandatory reservations. The State Govt. will give wide publicity to this order within 7 days from today. The students who wish to appear at the entrance examination will intimate their intention to appear either to the Principal of the Medical College, Calicut or to the Principal of the Medical College, Trivandrum with 3 copies of passport size photographs on or before 10th February, 1982. 3. The fee for the entrance examination shall be Rs. 10/- per candidate and this amount of fee shall be despatched by the students intending to appear at the entrance examination by Money Order or Postal Order or otherwise so as to reach on or before 13th February, 1982. 4. 3. The fee for the entrance examination shall be Rs. 10/- per candidate and this amount of fee shall be despatched by the students intending to appear at the entrance examination by Money Order or Postal Order or otherwise so as to reach on or before 13th February, 1982. 4. So far as admissions to the Medical Colleges for the academic year 1982-83 onwards are concerned, we affirm the formula 'evolved by the Kerala High Court in its judgment. There will be no order as to costs of these appeals.
