JUDGMENT B.N. Sapru, J. - This is an application under Section 5 of the Limitation Act. 2. An appeal was decided on 10-4-1979. The review application was presented in this Court on 20-8-79. It was 102 day beyond time. The explanation given for the delay is that after the judgment of the High Court the appellant applied for a certified copy of the judgment on 17-5-79 and it was received by him on 6-7-79. The appellants case is that he wanted to file an appeal in the Supreme Court. In that connection he contacted Sri Yogeshwar Dayal in Delhi on 29.7.79 but Sri Dayal advised him that a review application should be filed. Thereafter the appellant came back from Delhi to Pilibhit where he contacted his son. He again went to Delhi and contacted Sri Yogeshwar Dayal and thereafter the review application was filed. 3. It is true that the limitation for filing an appeal in the Supreme Court is 90 days whereas a review has to be filed within 30 day. However, the copy was applied for more than 30 days after the judgment i.e., after the period of limitation for filing a review application. 4. In the circumstances I find that there is no justification for condoning the delay in filing the review application. The application under Section 5 Limitation Act, is accordingly dismissed.
