JUDGMENT : V.D. Tulzapurkar, J. - Leave granted. 2. After hearing counsel on either side the following order is passed. 3. The trial court's order dated 3-12-82 which has been confirmed by the High Court on December 21, 1982 is varied to the following extent only. 4. As regards the access to the children made available to the respondent under the court's order on the second and fourth Saturday and the following Sundays the access is altered and restricted to the 2nd and 4th Sundays and there will be no question of any overnight stay of the children with the respondent on the previous Saturdays. In other words on the 2nd and 4th Sundays the children will be left by the petitioner with the respondent at 9.30 a.m. and the respondent will return them to the petitioner at 8 p.m. on the very day. The petitioner is not to take the children to the respondent on 2nd and 4th Saturdays. The order relating to the respondent having vacation access to the children is deleted for the present and the City Civil Court (one of the judges hearing matrimonial causes) is directed to give precedence and hear and dispose of the suit as expeditiously as possibly preferably before the commencement of the summer vacation for the schools in Bombay that is to say before the end of April 1983. Both the parties will cooperate and get ready for such hearing without putting forth any excuses or obstacles. In case the trial court is unable for any reason to dispose of the matter within the period indicated above, liberty is granted to the parties to move this Court for further directions regarding access during the vacation. Order accordingly.
