JUDGMENT P. C. Borooah, J.–The petitioners had filed an appeal against an order of confiscation passed on 18.5.83 by the Collector, Midnapore under Act X of 1955 in a proceeding arising out of Kharagpur (T) P. S. case No. 44 dated 29.8.81. Sri A. C. Chatterji, Special Officer under the aforesaid Act in admitting the appeal by his order dated 4.6.83 rejected the prayer of the petitioner for stay of operation of confiscation order against this the petitioner has moved this instant application with notices to the State. 2. We have heard Mr. Balai Chandra Roy on behalf of the petitioners and Mr. Asi Ranjan Mondal on behalf of the State. 3. The whole appeal becomes infructuous if confiscation proceedings are not stayed. 4. Under the circumstances we direct that the confiscation order passed by the Collector, Midnapore will remain stayed till the appeal is disposed of. The application is thus disposed.
