JUDGMENT 1. - Heared learned counsel for the petitioners, learned P. P. and the learned counsel for the complainant. 2. All these three bail applications being connected are disposed of by this order. 3. Learned counsel for the petitioners and the learned P. P. have argued at length and a number of statements of the witnesses, who have been examined in the Court of Session have been read over to me to show that there is a conspiracy in this case, and on account of the said conspiracy Smt. Rama was murdered. It was argued that this is a case of extracting dowry money from the parents of Smt. Rama deceased and in that act this heinous offence has been committed. 4. I have considered the arguments and I do not want to express any opinion on the merits of the case and the evidence which has been recorded in the trial court. 5. Before me, these are the bail applications. In the trial court, the prosecution evidence has been closed, and as argued by the learned counsel for the petitioner there is no question of tampering with the prosecution evidence now. It is also admitted that the case is now fixed for 16-6-83 for recording the statement of the accused, and then the defence evidence will be taken up, and therefore the case will be heard finally. Though, it is a murder case connected with dowry, but I feel that after all the accused be also provided an opportunity to lead defence evidence and to prove his innocence. I further feel that one of the accused persons should be released on bail, so that they may be able to face the trial and lead defence evidence, if they so desire. 6. The bail applications of Balkishan No. 490/83 and of Mahesh Narain No. 491/83 are not pressed by the learned counsel for the petitioner. As such, they are dismissed as not pressed. 7. The bail application of Shri Suresh Narain accused-petitioner No. 492/83 is hereby accepted and it is hereby ordered that he may be released on bail, provided he furnishes a personal bond of Rs. 10,000/- and two sureties of 5000/- each to the satisfaction of the learned Sessions Judge, Bharatpur, for appearance in his Court or any other Court, during the trial and whenever called upon to do so. *******
